Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the ex-plore website and booking platform. By accessing or using our service, you agree to be bound by these Terms.

Counsel note: This document is a good-faith template drafted for the ex-plore prototype. It must be reviewed by qualified legal counsel and adapted to reflect the exact corporate entity, registered address, applicable jurisdiction(s), ATOL/ABTA or equivalent bonding requirements, and live operational and liability details before publication.

1. Acceptance of terms

By accessing ex-plore.com (“the Site”) or using our tour-booking services, you confirm that you are at least 18 years of age, have legal capacity to enter into a binding contract, and agree to these Terms and our Privacy Policy.

If you are booking on behalf of other travellers, you confirm that you have authority to bind each member of your group to these Terms.

2. Our services

ex-plore operates a curated marketplace connecting travellers with specialist Morocco journey experiences. We provide:

  • An online platform for browsing, enquiring about, and booking Morocco tours
  • Personalised journey proposals from our specialist team
  • Deposit and balance payment processing via Stripe
  • Post-booking support and trip documentation

We act as the booking agent. Specific tour operations (ground transport, accommodation, guiding) are delivered by vetted local partner operators in Morocco. Applicable supplier terms may also apply to your booking.

3. Accounts

You may browse the Site without an account. To save tours, submit enquiries, or complete bookings, you must create an account using your email address and our one-time-password (OTP) system.

You are responsible for maintaining the confidentiality of your account and for all activities carried out under it. Please notify us immediately at support@ex-plore.com if you believe your account has been compromised.

4. Bookings and payments

4.1 Booking process

A booking is confirmed when: (a) you complete the booking form on the Site; (b) we receive and process your deposit payment; and (c) we send you a booking confirmation email containing your reference number. A booking reference constitutes our acceptance of your booking.

4.2 Deposit

A non-refundable deposit (currently 20% of the total tour price, subject to change) is required to confirm your booking. The remaining balance falls due as stated in your booking confirmation.

4.3 Pricing

All prices are shown in the currency selected. Unless stated otherwise, catalogue prices are for a private vehicle (the whole trip or day), not per person. Multi-day packages include the default vehicle and classic accommodation standing; upgrades for a larger vehicle or higher lodging standing are charged as whole-trip add-ons. Day products (for example wine days) are private-vehicle day rates. Traveller count does not multiply the base vehicle price; it only determines vehicle capacity. Optional experiences and extras are added to the package total. Prices are subject to change until a booking is confirmed. Airfare is not included unless explicitly stated.

4.4 Payment security

All payments are processed by Stripe, Inc. ex-plore does not store, transmit, or process raw card data. Your card details are governed by Stripe’s PCI-DSS compliant environment.

5. Cancellations and refunds

5.1 Cancellation by you

All cancellations must be notified to us in writing. The following cancellation fees apply (calculated on the total tour price):

5.2 Cancellation by us

We reserve the right to cancel a tour in exceptional circumstances (e.g. force majeure, minimum group size not met, safety concerns). In such cases, we will offer you an alternative date, alternative tour of equivalent value, or a full refund of monies paid to us.

6. Traveller responsibilities

You are responsible for:

  • Holding a valid passport (with at least 6 months validity) and any required visas for Morocco and any transit countries
  • Ensuring you have appropriate travel insurance covering medical expenses, evacuation, and cancellation
  • Disclosing any medical conditions or special requirements at the time of booking
  • Following the reasonable instructions of our guides and partner operators during the tour
  • Ensuring the accuracy of all information provided when booking

7. Limitation of liability

To the maximum extent permitted by applicable law:

  • ex-plore shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Site or any booking.
  • Our total liability to you in connection with any booking shall not exceed the total price paid by you for that booking.
  • We are not liable for events outside our reasonable control, including but not limited to: war, terrorism, natural disasters, strikes, pandemic, government travel restrictions, or acts of third-party suppliers.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

8. Intellectual property

All content on the Site — including text, images, itineraries, maps, branding, and software — is owned by or licensed to ex-plore. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Prohibited use

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorised access to any system or account
  • Submit false, misleading, or fraudulent information
  • Use automated tools (scrapers, bots) to extract data from the Site
  • Engage in any conduct that disrupts or damages the Site

10. Account deletion and data rights

You may delete your account and request erasure of your personal data at any time from the Settings tab in your account. When you delete your account:

  • Your profile and saved tours are permanently deleted
  • Your enquiry and booking records are anonymised (PII stripped) but the financial record is retained for our legal obligations
  • Your authentication account is deleted

11. Governing law and disputes

These Terms are governed by the laws of Morocco. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Marrakech, Morocco, without prejudice to any mandatory consumer rights you may hold under the laws of your country of residence.

12. Changes to these terms

We may update these Terms from time to time. The current version is always available at ex-plore.com/terms. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Material changes will be notified by email.
